Article 1 - Purpose<\/h2>\n\n\n\n

The company Ch\u00e2teau de Pibarnon, a Soci\u00e9t\u00e9 Civile d\u2019Exploitation Agricole (Agricultural Land Management Corporation) with a share capital of \u20ac353,788.43, registered with the Toulon Trade and Companies Register under No. 380 769 182, having its registered office at 410, Chemin de la Croix des Signaux, La Cadi\u00e8re d\u2019Azur (83740), and whose individual VAT identification number is FR56380769182 (hereinafter referred to as \"Scea Ch\u00e2teau de Pibarnon\"), offers alcoholic beverages for sale on the website http:\/\/www.pibarnon.com<\/a> (hereinafter referred to as the \"Website\"), to any person (hereinafter referred to as the \"Buyer\").<\/p>\n\n\n\n

The Estate can be reached by phone at 04.94.90.12.73 (cost of a local landline call), by post at the following address: Ch\u00e2teau de Pibarnon - 410, Chemin de la Croix des Signaux, 83740 La Cadi\u00e8re d\u2019Azur, and by email at the following address: contact@pibarnon.fr.<\/p>\n\n\n\n

These general terms and conditions of sale (\"GTC\") govern all relations between Scea Ch\u00e2teau de Pibarnon and the Buyer, residing in metropolitan France, who has reached the legal age required to purchase alcoholic beverages. The purchase of products (as defined in Article 2 hereof) for resale is prohibited. In France, minors under the age of 18 may not purchase products on the Website, as the sale of alcoholic beverages to minors under 18 is prohibited in accordance with Article L.3342-1 of the French Public Health Code.<\/p>\n\n\n\n

The GTC apply to all orders placed by the Buyer, to the exclusion of all other conditions and any other documents such as brochures, press, catalogues, or emails issued by Scea Ch\u00e2teau, which are for indicative purposes only.<\/p>\n\n\n\n

The Buyer acknowledges having read the GTC and having accepted them unreservedly in their entirety by validating their order and checking the box: \"By proceeding to payment, you definitively validate your order, accept the entirety of our general terms and conditions of sale, and certify on your honor that you are of legal age to purchase alcohol.\"<\/em> Scea Ch\u00e2teau de Pibarnon reserves the right to modify the GTC at any time and without prior notice. The applicable GTC are those in force on the date of the order.<\/p>\n\n\n\n

Article 2 - Description of the Products<\/h2>\n\n\n\n

Scea Ch\u00e2teau de Pibarnon offers various ranges of wine for sale (hereinafter referred to as the \"Products\"). A list of the Products is available on the Website.<\/p>\n\n\n\n

It is specified that, given the nature of these products, which are subject to the rules applicable to \"Bandol\" Appellation d\u2019Origine Contr\u00f4l\u00e9e (AOC) wines, they are by nature limited in quantity, so that the products offered by the company Ch\u00e2teau de Pibarnon are always subject to stock availability.<\/p>\n\n\n\n

If the customer feels insufficiently informed about the characteristics of the products they wish to purchase from Ch\u00e2teau de Pibarnon, they may, prior to placing any order, request additional information about these products, notably by calling the following number: 04.94.90.12.73. Ch\u00e2teau de Pibarnon undertakes to provide the customer with all additional information they may wish to obtain, so that they are fully informed about the nature and characteristics of the products they wish to order before placing the order.<\/p>\n\n\n\n

As soon as the customer feels sufficiently informed about the nature and characteristics of the products they wish to order, they may place their order. It is specified that by placing an order, the customer implicitly acknowledges having obtained all the information they desired regarding the nature and essential characteristics of the products ordered.<\/p>\n\n\n\n

Article 3 - Order<\/h2>\n\n\n\n

3.1 Registration<\/h3>\n\n\n\n

Before placing any order, the Buyer may log in if they have already opened a customer account. To do so, they simply need to enter:<\/p>\n\n\n\n

  • Their username (their email)<\/li>\n\n\n\n
  • Their password<\/li>\n<\/ul>\n\n\n\n

    If the Buyer does not have a customer account, they can register online by filling out the form provided for this purpose. To do so, they must provide the following information, it being specified that this list is not exhaustive and is subject to modification by Scea Ch\u00e2teau de Pibarnon:<\/p>\n\n\n\n

    • Last Name<\/li>\n\n\n\n
    • First Name<\/li>\n\n\n\n
    • Address<\/li>\n\n\n\n
    • Postal Code<\/li>\n\n\n\n
    • City<\/li>\n\n\n\n
    • Telephone<\/li>\n\n\n\n
    • Email address (username)<\/li>\n\n\n\n
    • Password<\/li>\n\n\n\n
    • Confirm password<\/li>\n<\/ul>\n\n\n\n

      Upon completion of the login process, the Buyer directly accesses the online shop. Upon completion of the registration process, Scea Ch\u00e2teau de Pibarnon will, after validation, send the Buyer an account opening confirmation email, containing the username and password chosen by the latter, so that they only need to activate the link sent to access the online shop.<\/p>\n\n\n\n

      The Buyer undertakes to provide accurate, complete, and updated information. The Buyer is the only person authorized to use the username and password they have previously chosen and must take all necessary measures to maintain this confidentiality.<\/p>\n\n\n\n

      In particular, the Buyer undertakes to inform Scea Ch\u00e2teau de Pibarnon of any unauthorized use of their account or password, or any breach of their account's security. This notification, accompanied by the Buyer's order or account number, must be sent to Scea Ch\u00e2teau de Pibarnon by email to the following address: contact@pibarnon.fr. The Buyer is responsible for the use of the Website made under their password until they have changed it via their account.<\/p>\n\n\n\n

      The Buyer may close their account at any time by sending an email to Scea Ch\u00e2teau de Pibarnon at the following address: contact@pibarnon.fr. The closure of the Buyer's account for any reason terminates the contractual relationship between them and Scea Ch\u00e2teau de Pibarnon.<\/p>\n\n\n\n

      3.2 Placing the Order<\/h3>\n\n\n\n

      For any order of Products, the process is as follows, and the Buyer:<\/p>\n\n\n\n

      • Connects to the Website,<\/li>\n\n\n\n
      • Logs in under the conditions described above or fills out the registration form on which the Buyer indicates all the details listed in Article 3.1 above,<\/li>\n\n\n\n
      • After receiving their username and password electronically, selects the desired Product, which is added to the \"Cart\" at the top right,<\/li>\n\n\n\n
      • Validates the Product(s) and clicks on the button \"Validate and pay for my order\",<\/li>\n\n\n\n
      • Checks the order confirmation box and accepts the \"GTC\" unreservedly in their entirety by checking the box \"By proceeding to online payment, you definitively validate your order, accept the entirety of our general terms and conditions of sale, and certify on your honor that you are of legal age to purchase alcohol\"<\/em>,<\/li>\n\n\n\n
      • Enters the delivery address and, if different, the billing address,<\/li>\n\n\n\n
      • Chooses the delivery method according to the terms described in Article 6 hereof,<\/li>\n\n\n\n
      • Is informed of the various duties and taxes applicable to the transaction, which are added to the price including all taxes (TTC) of the Product shown on the Website,<\/li>\n\n\n\n
      • Validates the order after checking it and being informed of the upcoming payment,<\/li>\n\n\n\n
      • Validates the payment method by bank card (Carte Bleue, Visa, or Mastercard),<\/li>\n\n\n\n
      • Makes the payment under the terms provided,<\/li>\n\n\n\n
      • Confirms the order and payment,<\/li>\n\n\n\n
      • Is informed that they will receive an order confirmation solely by email.<\/li>\n<\/ul>\n\n\n\n

        Up until the \"Payment\" step, the Buyer can modify their order by clicking on the \"Cart\" icon at the top right. The indivisible ordering unit is a full box of 6 bottles and multiples of 6 (all references combined), or 3 magnums and multiples of 3 (all references combined). Final acceptance is therefore carried out by confirming the entry of bank details (card number, expiration date, and security code).<\/p>\n\n\n\n

        3.3 Order Confirmation<\/h3>\n\n\n\n

        An order confirmation is displayed on the Website after its final acceptance by the Buyer. The order confirmation includes a summary of the order content, the order number, date, and time, the payment method used, the detailed amount of the order, and the Buyer's billing and delivery addresses. The order confirmation is simultaneously sent to the Buyer by email.<\/p>\n\n\n\n

        Scea Ch\u00e2teau de Pibarnon reserves the right to take up to 48 business hours to validate the Buyer's order to ensure product availability.<\/p>\n\n\n\n

        3.4 Right of Withdrawal - For Consumer Buyers Only<\/h3>\n\n\n\n

        In accordance with Article L.121-21 of the French Consumer Code, the Buyer may, within fourteen (14) days following receipt of the Products, exercise their right of withdrawal by notifying their intent to withdraw under the conditions described below. Withdrawal is carried out:<\/p>\n\n\n\n

          Products must be returned in their original packaging, in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold as new, accompanied by the purchase invoice.<\/sup> Damaged, soiled, or incomplete Produ<\/sup>cts will not be accepted.<\/p>\n\n\n\n

          The transport method chosen by the Buyer to return the Products must be similar to the one used by Scea Ch\u00e2teau de Pibarnon for the delivery of the Products. If the right of withdrawal is exercised within the aforementioned period, only the price of the purchased Product(s) and the delivery costs will be reimbursed; the return costs remain the responsibility of the Buyer.<\/p>\n\n\n\n

          The exchange (subject to availability) will be carried out within fourteen (14) days from the receipt by Scea Ch\u00e2teau de Pibarnon of the Products returned by the Buyer under the conditions provided for in this article.<\/p>\n\n\n\n

          3.5 Specific Conditions for Certain Orders<\/h3>\n\n\n\n

          3.5.1<\/strong> Scea Ch\u00e2teau de Pibarnon may refuse any order indicating that the Buyer is not an individual but a professional.<\/p>\n\n\n\n

          3.5.2<\/strong> Scea Ch\u00e2teau de Pibarnon may refuse any order that appears suspicious regarding the true identity of the customer, the ownership of the payment method used, or the delivery address provided by the customer.<\/p>\n\n\n\n

          3.5.3<\/strong> Scea Ch\u00e2teau de Pibarnon reserves the right, prior to accepting the order, to request in writing from the customer any required supporting documents regarding their identity, ownership of the payment method used, and the requested delivery address. It is specified that if the customer fails to provide the requested proof in writing to Ch\u00e2teau de Pibarnon within 8 days from receipt of the request made by Ch\u00e2teau de Pibarnon, the latter shall be entitled to refuse the order placed.<\/p>\n\n\n\n

          3.6 Modification of the Order<\/h3>\n\n\n\n

          The Buyer may request a modification of the billing address and delivery address, provided that this request is made no later than the day following the date of order confirmation, by contacting the Estate by phone at 04.94.90.12.73 (cost of a local landline call) during the Estate's opening hours, every business day, from 9:00 AM to 5:30 PM. No modification of the billing address or delivery address is possible if the conditions stipulated above are not respected.<\/p>\n\n\n\n

          3.7 Availability of Products<\/h3>\n\n\n\n

          When the order is placed, Scea Ch\u00e2teau de Pibarnon undertakes to make every effort to provide the Buyer with information regarding the availability of the various Products. In the event of temporary unavailability of Products discovered after the order has been placed, the Buyer will be informed as soon as possible by email and will be given, if applicable, the additional delivery timeframe.<\/p>\n\n\n\n

          If the timeframe is an essential condition for the Buyer, they must contact the Estate by phone at 04.94.90.12.73 (cost of a local landline call) or by email at the address contact@pibarnon.fr, during the aforementioned opening hours of the Estate.<\/p>\n\n\n\n

          If the timeframe is an essential condition, or if the order is not delivered after the additional timeframe following a formal notice sent by registered letter with acknowledgment of receipt, the Buyer may cancel the order in writing. They will be fully reimbursed no later than fourteen (14) days following receipt of the order cancellation notice. Scea Ch\u00e2teau de Pibarnon reserves the right to take up to 48 business hours to validate the Buyer's order to ensure product availability.<\/p>\n\n\n\n

          3.8 Order Archiving<\/h3>\n\n\n\n

          Each order is archived by Scea Ch\u00e2teau de Pibarnon for a period of one (1) year from the date of the last delivery. At any time, the Buyer can access the details of their past orders by sending an email to the Estate at the following address: contact@pibarnon.fr.<\/p>\n\n\n\n

          3.9 Evidence Agreement<\/h3>\n\n\n\n

          All data and computer or digital files recorded on the Website's IT infrastructure will serve as proof between Scea Ch\u00e2teau de Pibarnon and the Buyer regarding the facts to which they relate.<\/p>\n\n\n\n

          Article 4 - Price<\/h2>\n\n\n\n

          4.1<\/strong> Prices are expressed in euros, all taxes included (TTC), and excluding delivery costs for metropolitan France only. The delivery costs for the Products are provided for in Article 6.1.2 below. Before validating the order, the Buyer is informed of the transport price and the total price to be paid (including, where applicable, VAT and transport costs).<\/p>\n\n\n\n

          4.2<\/strong> Scea Ch\u00e2teau de Pibarnon has the option to modify its prices at any time. However, the price appearing on the Website on the day of order validation is the only one applicable.<\/p>\n\n\n\n

          4.3<\/strong> Price discrepancies between the Estate's physical shop and the Website may exist, due to two very distinct competitive realities.<\/p>\n\n\n\n

          Article 5 - Payment<\/h2>\n\n\n\n

          5.1<\/strong> The price is due and collected in full upon validation of the order. Payments are made online by credit\/debit card (Carte Bleue, Visa, or Mastercard). The price amount (after entering bank details) is debited only after the order has been validated by Scea Ch\u00e2teau de Pibarnon within a period that may take up to 48 hours.<\/p>\n\n\n\n

          5.2<\/strong> In the event that payment of the price is incomplete or non-existent for a reason attributable to the Buyer, the order will be automatically cancelled, and any resulting costs will be borne by the Buyer, without prejudice to any potential damages.<\/p>\n\n\n\n

          5.3<\/strong> The Buyer is informed and consents to the invoice corresponding to their purchase being sent to them along with the Products upon delivery.<\/p>\n\n\n\n

          Article 6 - Delivery<\/h2>\n\n\n\n

          6.1 Delivery<\/h3>\n\n\n\n

          The Buyer may, at their choice:<\/p>\n\n\n\n

            \n
          • Have the Products delivered to the address of their choice;<\/li>\n\n\n\n
          • Collect the ordered Products directly from the Estate.<\/li>\n<\/ul>\n\n\n\n

            6.1.1 Terms and Delivery Timeframes<\/h4>\n\n\n\n

            In the case of home delivery, the Products are delivered to the address specified by the Buyer when placing their order. The delivery address may be different from the billing address. Deliveries only take place in metropolitan France. Shipments take place every week in metropolitan France only, on Mondays, Tuesdays, and Wednesdays (excluding public holidays).<\/p>\n\n\n\n

            Shipment times vary depending on the date of order confirmation, it being specified that the standard delivery timeframe is one week.<\/p>\n\n\n\n

            The customer undertakes to be present at the time of delivery or to indicate a delivery address where a third party can receive the delivered products. Furthermore, the customer undertakes to provide Ch\u00e2teau de Pibarnon with all the information necessary for the correct execution of the delivery of the ordered products, such as their exact address, telephone number, entry door code, or directions to reach the delivery location.<\/p>\n\n\n\n

            Scea Ch\u00e2teau de Pibarnon makes its best efforts to ship the ordered Products within the timeframes specified above. However, these shipment times are communicated for indicative purposes only. In the event of a significant shipment delay known to Scea Ch\u00e2teau de Pibarnon, the Buyer will be informed as soon as possible by email and will be given, if applicable, the additional shipment timeframe.<\/p>\n\n\n\n

            If the timeframe is an essential condition for the Buyer, they must contact the Estate by phone at 04.94.90.12.73 (cost of a local landline call) or by email at contact@pibarnon.fr, during the aforementioned opening hours of the Estate.<\/p>\n\n\n\n

            If the timeframe is an essential condition, or if the order is not delivered at the end of the additional timeframe, for any reason other than force majeure or the Buyer's own doing, after a formal notice sent by registered letter with acknowledgment of receipt, the Buyer may cancel the order in writing under the conditions provided for in Articles L 138-2 and L 138-3 of the French Consumer Code. They will be fully reimbursed no later than fourteen (14) days following receipt of the order cancellation notice.<\/p>\n\n\n\n

            The Products delivered and invoiced to the Buyer remain the property of Scea Ch\u00e2teau de Pibarnon until full payment of their price. Failure to pay may lead to the reclamation of the Products by Scea Ch\u00e2teau de Pibarnon. The above provisions do not prevent the transfer to the Buyer, upon delivery, of the risks of loss or deterioration of the Products, as well as any damage they might cause.<\/p>\n\n\n\n

            6.1.2 Delivery Costs<\/h4>\n\n\n\n

            Delivery costs:<\/p>\n\n\n\n

              \n
            • Are set at a flat rate under conditions established in the pricing structure of the company Ch\u00e2teau de Pibarnon, for any delivery in metropolitan France.<\/li>\n\n\n\n
            • Are, in any event, borne by the Buyer and,<\/li>\n\n\n\n
            • Are specified when placing the order, prior to any validation of the order by the Buyer.<\/li>\n<\/ul>\n\n\n\n

              The Buyer may be exempted from paying delivery costs for any order delivered in metropolitan France that meets the following conditions:<\/p>\n\n\n\n

              • Orders greater than 24 bottles.<\/li>\n<\/ul>\n\n\n\n

                6.1.3 Returns and Exchanges<\/h4>\n\n\n\n

                Scea Ch\u00e2teau de Pibarnon undertakes to exchange the Products in the event that they are visibly damaged before unpacking or do not conform to the order, under the following conditions:<\/p>\n\n\n\n

                  \n
                • In the event of damage, missing items, or non-conformity of the Products, the Buyer has made their claims immediately to the carrier on the delivery note provided by the latter and has transmitted to the Estate a photograph of the package with the delivery label clearly visible and legible, and a photograph of the Products damaged during transport,<\/li>\n\n\n\n
                • The Buyer contacted the Estate on the day of receipt of the Products:\n
                    \n
                  • By phone: 04.94.90.12.73 (cost of a local landline call),<\/li>\n\n\n\n
                  • Or by email at the following address: contact@pibarnon.fr,<\/li>\n\n\n\n
                  • Or by post at the following address: Ch\u00e2teau de Pibarnon - 410, Chemin de la Croix des Signaux, 83740 La Cadi\u00e8re d\u2019Azur.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
                  • After a period of 8 days, no claim regarding the condition, conformity of the products, or missing items will be accepted by the company Ch\u00e2teau de Pibarnon, which will be released from all liability, the products then being deemed compliant with what was ordered.<\/li>\n<\/ul>\n\n\n\n

                    As soon as the Buyer's claim is accepted, the Estate will contact the Buyer to arrange for the shipment of new Products. The return of the Products by the Buyer is carried out at their own expense to the address indicated above. Scea Ch\u00e2teau de Pibarnon will only refund return costs on the condition that it has previously acknowledged responsibility for the non-conformity with the order.<\/p>\n\n\n\n

                    6.2 Collection at the Estate<\/h3>\n\n\n\n

                    By choosing the \"Collection at the Estate\" method, the Buyer undertakes to come and collect their order directly at Ch\u00e2teau de Pibarnon, located at 410, Chemin de la Croix des Signaux in La Cadi\u00e8re d\u2019Azur (83740), during the cellar opening hours, every day from 9:00 AM to 12:00 PM and from 2:00 PM to 6:00 PM, except Sundays and public holidays.<\/p>\n\n\n\n

                    The Products are made available to the Buyer at Ch\u00e2teau de Pibarnon at the aforementioned address for a period of one (1) year from receipt by the latter of the availability confirmation email, which is sent within 48 business hours from the order confirmation sent to the Buyer.<\/p>\n\n\n\n

                    If, at the end of this period, the Buyer has not appeared to collect their order, Scea Ch\u00e2teau de Pibarnon will proceed with the outright cancellation of the order.<\/p>\n\n\n\n

                    Article 7 - Liability<\/h2>\n\n\n\n

                    7.1<\/strong> The liability of Scea Ch\u00e2teau de Pibarnon cannot be called into question if the non-performance or delay in the performance of an obligation results from a case of force majeure (notably in the event of natural disasters, fires, internal or external strikes, internal or external failures or breakdowns) or from an unpredictable and insurmountable act of a third party.<\/p>\n\n\n\n

                    7.2<\/strong> Scea Ch\u00e2teau de Pibarnon cannot be held liable for potential errors made by the Buyer in the choice of Products when placing the order.<\/p>\n\n\n\n

                    7.3<\/strong> The Products are packed in suitable packaging to limit the risk of breakage. The Buyer must nevertheless unpack the package with care, caution, and thoroughness, as Scea Ch\u00e2teau de Pibarnon cannot be held responsible for breakage resulting from opening the packaging.<\/p>\n\n\n\n

                    7.4<\/strong> The Products and their characteristics are described and represented as accurately as possible on the Website. However, it cannot be ruled out that slight differences in typography, size, color, and proportion may exist between the reproduction of the Products on the Website and the delivered Products. In such cases, Scea Ch\u00e2teau de Pibarnon cannot be held liable.<\/p>\n\n\n\n

                    7.5<\/strong> Scea Ch\u00e2teau de Pibarnon is only bound by an obligation of best endeavors regarding the operation and continuity of the Website. Consequently, Scea Ch\u00e2teau de Pibarnon cannot be held liable for damage resulting from the use of the Website or the Internet network, such as data loss, intrusion, viruses, access speeds to the site from other websites, opening and consultation speeds of the Website pages, external slowdowns, suspension or inaccessibility of the Website, fraudulent use by third parties of any information made available on the site, technical breakdowns and problems concerning hardware, programs, or software that may, if applicable, lead to the suspension or termination of the Website, or if the Website proves incompatible or malfunctions with certain software, configurations, operating systems, or equipment of the Buyer, or other problems beyond its control.<\/p>\n\n\n\n

                    7.6<\/strong> The Website may contain hypertext links leading to other websites. Scea Ch\u00e2teau de Pibarnon makes no commitment regarding any other website that the Buyer may access via the Website and is in no way responsible for the content, operation, and access to these sites.<\/p>\n\n\n\n

                    7.7<\/strong> The Buyer is solely responsible for their use of the Website and the Products and shall not hold Scea Ch\u00e2teau de Pibarnon liable for any claim and\/or legal proceedings brought against them. The Buyer undertakes to handle personally any claim and\/or legal proceedings brought against Scea Ch\u00e2teau de Pibarnon that relate to their use of the service.<\/p>\n\n\n\n

                    Article 8 - Intellectual Property<\/h2>\n\n\n\n

                    8.1<\/strong> The Website and all the elements that compose it (texts, photographs, images, data, etc.) are protected by intellectual property rights which are and remain the exclusive property of Scea Ch\u00e2teau de Pibarnon.<\/p>\n\n\n\n

                    8.2<\/strong> The names, logos, and trademarks \"CHATEAU DE PIBARNON\", \"LES RESTANQUES DE PIBARNON\", and \"CH\u00c2TEAU DE PIBARNON VIEUX MARC CE MOURV\u00c8DRE\" appearing on the Website are and remain the exclusive property of Ch\u00e2teau de Pibarnon, a Scea governed by French law, whose registered office is located at 410, Chemin de la Croix des Signaux (83740), registered with the Toulon Trade and Companies Register under number 380 769 182. Any reproduction, dissemination, or use of an element of the Website or of the names, logos, and trademarks \"CHATEAU DE PIBARNON\" and \"LES RESTANQUES DE PIBARNON\" is strictly prohibited, under penalty of infringement.<\/p>\n\n\n\n

                    9.2 Personal Data Subject to Processing<\/h3>\n\n\n\n

                    The personal data subject to processing are those requested from the Buyer and communicated by them when placing orders, as well as the order numbers (hereinafter the \"Personal Data\"). Personal Data for which communication is mandatory are identified by a black asterisk. Failure to communicate Personal Data identified as mandatory prevents the placing of an order.<\/p>\n\n\n\n

                    The personal data processed also concern data obtained automatically when Customers connect to and navigate the Website, notably the IP address of their terminal, and\/or through computer files stored on their terminal, commonly known as \"cookies\" (hereinafter the \"Technical Data\").                         Scea Ch\u00e2teau de Pibarnon processes Technical Data for the purpose of optimizing and personalizing the Buyer's browsing experience on the Website.<\/p>\n\n\n\n

                        9.4 Recipients of Personal Data<\/h3>\n\n\n\n

                        The Personal Data and Technical Data collected are reserved for the use of Scea Ch\u00e2teau de Pibarnon and its contractors involved in placing or executing orders (partners of Scea Ch\u00e2teau de Pibarnon, payment providers, carriers...).<\/p>\n\n\n\n

                        9.5 Retention Period of Personal Data<\/h3>\n\n\n\n

                        Scea Ch\u00e2teau de Pibarnon retains Personal Data for the duration necessary for the processing purposes described in Article 9.3 above.                         Scea Ch\u00e2teau de Pibarnon archives Personal Data necessary for the exercise of a right and for proof of that right for the duration of the applicable statute of limitations or under the legal obligations to which it is subject. To this end, Scea Ch\u00e2teau de Pibarnon archives Personal Data relating to the Buyer's payment method for a period of thirteen (13) months, for evidentiary purposes, in the event of a dispute over the transaction. Scea Ch\u00e2teau de Pibarnon also archives Personal Data relating to the contract concluded with the Buyer for a period of 10 years from the delivery of the products, in accordance with Article L. 134-2 of the French Consumer Code.<\/p>\n\n\n\n

                        9.6 Rights of Access, Rectification, and Objection<\/h3>\n\n\n\n

                        In accordance with the French Data Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, on the protection of individuals with regard to the processing of personal data, the Buyer has a right to access, modify, and delete data concerning them, which they can exercise at any time by sending an email to Scea Ch\u00e2teau de Pibarnon at the following address: contact@pibarnon.fr, providing proof of their identity. The Buyer may also object to the processing of data concerning them for legitimate reasons, under the same terms as above.<\/p>\n\n\n\n

                        9.7 Security of Personal Data<\/h3>\n\n\n\n

                        Scea Ch\u00e2teau de Pibarnon implements current means aimed at preserving the confidentiality and security of the Personal Data and Technical Data of Buyers. The Personal Data and Technical Data of Buyers are processed by Scea Ch\u00e2teau de Pibarnon and its contractors on French territory.<\/p>\n\n\n\n

                        9.8 Declaration of Personal Data Processing<\/h3>\n\n\n\n

                        Scea Ch\u00e2teau de Pibarnon declared the processing of Personal Data and Technical Data above on February 5, 2016, to the CNIL, which registered it under number 1927767.<\/p>\n\n\n\n

                        Article 10 - Legal Warranties<\/h2>\n\n\n\n

                        10.1<\/strong> The Buyer benefits from the legal warranty of conformity in accordance with Articles L.211-4 et seq. of the French Consumer Code and the warranty against hidden defects in accordance with Articles 1641 et seq. of the French Civil Code.<\/p>\n\n\n\n

                        10.2<\/strong> In the event of non-conformity of a Product, it may be returned to Scea Ch\u00e2teau de Pibarnon to be exchanged, subject to the cost conditions provided for by Article L. 211-9 of the French Consumer Code. Any claim or request for exchange must be addressed to the Estate within a period of two (2) years from the delivery of the product. After this period, no claim is admissible. If the Buyer's claim is accepted, the Estate will contact the Buyer to proceed with the exchange of the Products.<\/p>\n\n\n\n

                        10.3<\/strong> If the Buyer decides to implement the warranty against hidden defects of the Product within the meaning of Article 1641 of the French Civil Code, they may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.<\/p>\n\n\n\n

                        Article 11 - Questions and Claims<\/h2>\n\n\n\n

In the event of a dispute between the Customer and the company, they shall endeavor to resolve it amicably (the Customer shall address a written claim to the professional or, where applicable, to the professional's Customer Relations Department).<\/p>\n\n\n\n
